The claim must have a genuine and supportable foundation in law. We look for matters that pass legal scrutiny, not speculative or opportunistic claims.
Commercial value
The claim must be commercially significant. The likely recovery should be proportionate to the time, cost and risk required to achieve it.
Reasonable prospects of success
We assess the strength of the evidence and the arguments. Matters must be realistically capable of a successful outcome.
Defendant capacity
The respondent should have the financial ability to meet a judgment. Funding is difficult to justify where recovery is unlikely even if you win.
Enforceability
A judgment is only valuable if it can be enforced. We consider the practical paths to recovery available against the respondent.
Viable litigation path
We favour matters with a clear, realistic route through the court or arbitration process, including a manageable budget and timeline.
How to improve your submission

- Share the likely value of the claim, if known, and the stage of proceedings.
